1. Nature of the service
Aventurator is a technological intermediary connecting travellers with Lanzarote operators and restaurants — not a tour operator or package-travel organizer. Upon booking, a service contract forms with the Operator and an intermediation contract with Aventurator, which collects payment on the Operator's behalf. The tax receipt for the activity is issued by the Operator; Aventurator invoices only its commission, to the Operator. Full identification in the Legal Notice.
2. Temporary spot hold (Yield Lock)
When you open a deal, Aventurator genuinely holds your spot for 60 seconds on the detail screen and 60 more on the payment screen. During that time the spot is removed from inventory so no one else can buy it — it is not a mere pressure countdown. If you do not complete payment, the spot is released automatically.
3. Price: you pay no fee
The price shown is the final price, taxes (IGIC) included. You pay no service fee whatsoever — no hidden charges, nothing added at checkout. Aventurator is paid entirely by the Operator: the agreed commission plus a flat €1.70 per booking charged to the Operator, never to you. Payment is processed by Stripe directly into the Operator's account; the Operator is the Merchant of Record.
4. No statutory right of withdrawal
Per Art. 16(l) Directive 2011/83/EU, leisure services for a specific date and time are excluded from the 14-day cooling-off right due to their perishable nature.
5. Cancellation and refunds
Last-minute spots are perishable and sold at exceptionally low prices, so bookings are final sale: they are not refundable if you change your mind, arrive late or do not show up. This is stated clearly before payment. With enough notice you may ask the Operator for a date or name change, without guarantee.
Full refund (100%, no handling charge) applies only in these cases: (a) the Operator cancels or cannot operate — including weather preventing safe delivery, equipment failure or minimum numbers not met; (b) force majeure or disaster; (c) an extraordinary public event preventing the activity. The refund is issued by the Operator through Stripe, as the party that took the payment, and reaches the same card in 5-10 business days; Aventurator supervises and notifies you. Free rescheduling is available instead if the Operator has availability.
6. Adventure Passport subscription
The subscription fee (€5/24h · €10/month · €60/year) grants immediate access to inventory and plan benefits. As an immediately-accessed digital service, once the benefit is used the fee is non-refundable, without prejudice to mandatory withdrawal rights under applicable consumer law (e.g. pro-rata refund for DE/AT residents under § 312k BGB where applicable). The subscription is rolling and may be cancelled at any time, effective at the end of the current period.
7. User obligations
- Accurate data, punctual arrival, follow safety instructions.
- Declare medical conditions, meet the minimum age stated in each listing.
- Respect the environment (UNESCO Biosphere Reserve).
8. Liability
Aventurator is responsible for the platform and payments. The Operator is solely responsible for activity delivery and must hold civil liability insurance. Contact the Operator first, then hello@aventurator.com.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, or for death or personal injury caused by negligence, nor any mandatory consumer rights (including, where applicable, the UK UCTA 1977 and Consumer Rights Act 2015).
9. Reviews
Post-activity reviews are moderated for defamation and third-party personal data — not for being negative.
10. Minors
Under-14s cannot contract directly; a parent or guardian books on their behalf. Some activities require a higher minimum age, stated in the listing.
11. Governing law
Spanish law. Courts of Arrecife, unless consumer law mandates the consumer's domicile. Aventurator is not currently adhered to a consumer ADR body (Art. 21 Law 7/2017); you may still contact hello@aventurator.com first, or go to the Canary Islands Consumer Arbitration Board or the accredited body in your EU country of residence. The EU Online Dispute Resolution platform was discontinued on 20 July 2025 (Regulation (EU) 2024/3228 repealing Regulation (EU) 524/2013).
